Court finds adversary’s actions are an “affront against fairness and . . . justice.”

Sanford Greenberg successfully concluded a lengthy litigation defending a member of a limited liability company in the business of purchasing non-performing mortgages.  An intra-company dispute regarding the alleged misappropriation of approximately $50 milion led to seven related lawsuits in federal and state courts in New York and Florida as well as a criminal investigation.  After nearly four years of intense litigation and a seven day trial in New York Supreme Court, the court dismissed all claims against our client.  A key to the successful outcome was Sanford’s ability to establish that our client’s e-mail account had been hacked by his former partner and that privileged communications between Sanford and his client had been  intercepted over a period of two months, conduct that the court described as an “affront against fairness and against the due administration of justice.”  Click here to read the Special Referee’s Report.  Click here to read the Trial Judge’s Decision affirming the Report.
